This is a revision against the order dated 28.5.2004 by the MACT, Jagadhri, by which the evidence of petitioner/respondent No. 3 was closed by the orders of the Court as despite the grant of last opportunity the petitioner did not conclude its evidence.
Learned counsel for the petitioner/respondent No. 3 states that on 28.5.2004 the petitioner was to file the verification report with regard to the genuineness of the driving licence. However, the report was not received by the petitioner. Therefore, it could not conclude its evidence. It is stated that there was no intention on the part of the petitioner to delay the proceedings. Learned counsel states that now the petitioner has received the report from the Licensing Authority, Ambala. Learned counsel prays that one opportunity be granted to the petitioner to lead its entire evidence.
Keeping in view the fact that because the report from the Licensing Authority, Ambala, had not been received by the petitioner, therefore, it could not conclude its evidence. The reasoning given by the counsel for the petitioner is convincing and I accept the same.
In view of the above, I grant one opportunity to the petitioner to lead its entire evidence. The petitioner shall now appear before the MACT, Jagadhri, on 29.7.2004. It shall pay costs of Rs. 5,000/ to the respondents. The costs shall be paid before the petitioner leads its evidence.
Revision disposed of.
Copy of the order be given Dasti.
Revision allowed.
