National Highways Authority Of India vs Soma Enterprises Ltd.

The present petition has been filed under Section 34 of the Arbitration and Conciliation Act, 1996 challenging the arbitral award dated 16.01.2017.

On 19.05.2026, learned Counsel appearing on behalf of the Petitioner sought time to obtain instructions in view of the Judgment of the Hon’ble Supreme Court in Prakash Atlanta (JV) v. National Highways Authority of India^{11.2026 SCC OnLine SC 98}, as the said judgment has a direct bearing on the issue involved in the present petition.

Today learned Counsel for the Petitioner, upon instructions submits that the present petition has been rendered infructuous and does not wish to pursue the same in light of the above stated judgment.

Learned Counsel for the Petitioner further submits that bank guarantee has already been returned to the Respondent.

In view of the above, no cause survives for adjudication in the present petition.

Accordingly, the present petition is disposed of as infructuous.
