None appears for the petitioner in second round after pass over. Counter-affidavit filed on behalf of respondent No. 3 in court is taken on record.

Learned Counsel for Union of India as well as State of U.P. submit that order of detention passed by the State Government has since been revoked.

Para-4 of the counter-affidavit filed on behalf of respondent No. 3 on re-production reads as under:

That the Central Government vide his order R/G No. 11/15028/474/2009/NSA dated 10.7.2009 revoked the detention order dated 15.6.2009 passed by the District Magistrate, Pratapgarh under the National Security Act, which was received at the District Jail, Pratapgarh on 13.7.2009. The detenue/petitioner has been released on the same day i.e. 13.7.2009 from N.S.A. but the petitioner is still detained in the District Jail, Pratapgarh as an under trial prisoner in Case Crime No. 130/ 2009 u/s 379/411 I.P.C. and 136/137 Electricity Act and 3/5 U.P. Transfer Act. All concerned authorities have been informed about release of detenue/petitioner on 13.7.2009. Date of production of detenue is fixed before U.P. Advisory Board on 15.7.2009. Since detenue has been released from N.S.A. on 13.7.2009, hence no need of production of the detenue/petitioner before the Advisory Board on 15.7.2009 and same is informed accordingly to the the Advisory Board. A true copy of the order dated 10.7.2009 passed by Central Government is being filed herewith as Annexure No. 1.

Thus, nothing survives in this petition. Hence, it is dismissed.
