Narinder Kumar vs Swarn Singh and Others

Gupta, J.—This appeal u/s 19(1) of the Contempt of Courts Act, 1971 is directed against the order of the Single Judge dated February 3,1984 whereby the contempt petition filed by Narinder Kumar was dismissed. According to the learned Single Judge after the petitioners have so appraised the Court, it is for the Court to see as to whether it should take notice of the contempt or not. The Court when permitted Santokh Singh Dhillon to withdraw the petition, showed disinclination to proceed in the matter of commission of its contempt by the respondents. In the circumstances, I do not consider it expedient that this Court should change its mind and renew the contempt proceedings this time at the instance of the tenant of the given shop."

In view of the Supreme Court judgment reported as D.N. Taneja Vs. Bhajan Lal, , no appeal as such u/s 19(1) is maintainable against the said order of the learned Single Judge where by no action was taken on the petition for contempt. Consequently, the appeal is dismissed as not maintainable.
