Notice. Mr. Vinod Thakur, learned Additional Advocate General, appears and waives service of notice on behalf of the respondents.

The instant petition has been filed for grant of the following substantive reliefs:-

i. Directions may kindly be issued to the respondents to Regularise the services of the petitioner after completion of 10 years of service from the initial date of appointment i.e. 22.11.2003 by giving seniority and continuity with all consequential benefits, in the light of judgment passed in L.PA. No. 170/2014, decided on 19.11.2014, titled as Balak ram v/s State of H.P. & ors. As also in view of Annexure P- 10(colly) and Annexure P-14(colly), whereby order has been passed in the matter of para teacher by giving clarification.

ii. The respondents may kindly be directed to regularize the entire break period, w.e.f. 08.7.2004 to 15-08-2013, which deserves to be regularized, with all consequential benefits, in view of Narain Singh's case, Annexure P- 13(colly).

Iii. The impugned AnnexureP-8 dated 20.05.2022, may kindly be quashed and set aside.

Learned counsel for the petitioner states that his client would be content, in case, the respondents are directed to consider and decide the case of the petitioner in light of the judgment rendered by this Court in LPA No. 170 of 2014, titled as Balak Ram vs. State of H.P. & Ors., decided on 19.11.2014. Prayer being innocuous is allowed.

Accordingly, the present petition is disposed of with a direction to the respondents to consider and decide the case of the petitioner in light of the judgment in Balak Ram's case (supra). In case, the case of the petitioner is found to be covered by the said judgment, then the same and similar benefit, as extended in the Balak Ram's case (supra), be also extended to the petitioner.

The petition stands disposed of in the aforesaid terms, so also pending applications, if any.
