Judgment
Jasbir Singh, J.—This revision petition has been filed against order dated 21.4.2004, vide which, while deciding application of the petitioner
No. 1 u/s 24 of the Hindu Marriage Act, 1955, she was granted Rs. 2,500 as litigation amount and Rs. 1,000 per month towards interim
maintenance for her and two children, who are residing with her.
Counsel for the parties heard.
This Court feels that in view of facts on record, the amount awarded is on the lower side. A finding has been given by the trial Court that the
respondent-husband can be presumed to have been earning Rs. 3,000 per month. This finding has not been challenged by the respondent. It has
also come on record and that one child is residing with the respondent and two are living with the wife. So by dividing Rs. 3,000 into five parts, this
Court feels that the petitioner wife is entitled to interim maintenance @ Rs. 1,800 per month from the date of her application. Litigation expenses
are also enhanced from Rs. 2,500 to Rs. 5,000.
Civil Revision stands disposed of.
