Special leave granted in all matters.
We may record that in the matter of this nature it is not proper normally for this Court to interfere with the choice of the Chairman made by the High Court and in the order we are making therein no reflection at all on the Chairman chosen by the Allahabad High Court, one of the representatives of the Financial Institutions. In the facts and circumstances of the case and in the interest of justice we, after hearing counsel for the parties and as agreed to by the parties, appoint Shri Jaswant Singh, Former Judge of this Court, as Chairman of the Annual General Meeting fixed to be held on 9th March, 1987. This meeting will be held under the chairmanship of Shri Jaswant Singh notwithstanding any order made by any Court or that may be made by any Court subsequently, stopping the meeting or appointing anybody else as the Chairman. The remuneration payable to Shri Jaswant Singh will be fixed by Shri Jaswant Singh. The Chairman will decide what is to be done with the proxies. The Registrar will intimate to Shri Jaswant Singh regarding his appointment as Chairman of the Annual General Meeting. It is agreed that inspection will be given on Sunday also. This order is made by consent of the parties and shall not be treated as a precedent. Appeals are disposed of accordingly, with no order as to costs.
