The petitioner seeks issuance of direction to respondents No.2 to 5 to transfer investigation to a senior officer in Punjab Police outside the jurisdiction of District Fatehgarh Sahib.
Learned counsel for the petitioner submitted that the matter arising out of FIR No.39, dated 29.4.2023 registered at Police Station Bassi Pathana, District Fatehgarh Sahib, under Sections 323, 341, 336, 506 of Indian Penal Code and Section 27 of Arms Act is not being farily investigated right from the very lodging of FIR inasmuch as although the accused Jagtar Singh had fired from his pistol at the son of the petitioner, but it is wrongly recorded in the FIR that shots were fired in the air.
I have heard learned counsel for the petitioner.
Admittedly, none of the shots fired by Jagtar Singh hit anybody. In any case, since investigation in respect of FIR No.39, dated 29.4.2023 is still underway, respondent No.4 – Senior Superintendent of Police, Fatehgarh Sahib is directed to ensure that the matter pertaining to FIR No.39, dated 29.4.2023 registered at Police Station Bassi Pathana, District Fatehgarh Sahib, under Sections 323, 341, 336, 506 of Indian Penal Code and Section 27 of Arms Act, is got investigated fairly and expeditiously in accordance with law, so that a final report under Section 173 Cr.P.C. is submitted thereafter at the earliest.
A copy of this order be conveyed to respondent No.4 – Senior Superintendent of Police, Fatehgarh Sahib for necessary compliance.
