Naresh Kumar vs State of H.P. and Others

Kuldip Singh, J.—The writ petition is filed with the following prayer:

That the respondents may be ordered to regularize the services of the petitioner from the date he completed eight years of service or in the alternative he may be offered work-charge status from the said date with all the consequential benefits since the work charge status is also available in the Forest Department and many people have been given the same.

It is the case of the petitioner that he has not been regularized so far after completion of eight years on the ground that he is a Nepali citizen even though petitioner is not a Nepali. It has been submitted that in any case the issue is covered in favour of the petitioner by the decision of this Court in CWP No. 1594 of 2008, titled Shri Man Singh v. The State of H.P. and Ors., decided on 27.7.2009 but that has not been considered. The petitioner may file appropriate representation before the first respondent, in which case, the mater will be duly considered by the first respondent in light of decision, referred to above, and appropriate action in accordance with law and justice in the matter will be taken within a period of four months. The petitioner will produce a copy of this judgment along a copy of the decision, referred to above, before first respondent.

With the above observations, the writ petition stands disposed of so also the pending application(s), if any.
