The present bail applications have been filed under Section 439 Cr.P.C. on behalf of the petitioners who are in custody in connection with F.I.R.

No.09/2020, Police Station Sadari, District Pali, for the offences under Sections 364-A, 368 & 120B IPC.

Heard learned counsel for the petitioners and learned Public Prosecutor. Perused the material available on record.

It is submitted by learned counsel for the petitioners that there is a regular business transaction between the petitioners and the complainants. On

demanding the money due to be paid by the complainant, same was not paid and therefore, the complainant was forcibly made to sit in the business

premises of the petitioners.

Learned Public Prosecutor on the strength of the case diary submits that as per statement of the victim Varun Kumar, it is clear that there was a

business transaction between the petitioners and the complainants and there were certain amounts due which were not being paid and therefore, the

complainant was confined in the business premises of the petitioners. No harm was caused to the victim Varun Kumar except asking him to pay the

amount due to them.

Having regard to the facts and circumstances of the case and upon a consideration of the arguments advanced, this Court is of the opinion that the bail

applications filed by the petitioners deserve to be accepted.

Consequently, the bail applications filed under Section 439 Cr.P.C. are allowed. It is ordered that the accused-petitioners (1) Naresh Kumar S/o

Mohan Lal (2) Jitender Singh S/o Mahipal Singh (3) Khuman S/o Puna Ram arrested in connection with F.I.R. No.09/2020, P.S. Sadari, District Pali

shall be released on bail; provided they furnish a personal bond of Rs.50,000/- (Rupees: Fifty Thousand Only) each with two sureties of Rs.25,000/-

(Rupees : Twenty Five Thousand Only) each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of

hearing and as and when called upon to do so.
