Case Diary is perused. Learned Counsel for the rival parties are heard.
Applicant apprehends arrest in connection with offences punishable u/Ss. 147, 148, 149, 323, 325 & 326 of IPC registered as Crime No. 83/2010, at Police Station Gijora, District - Gwalior.
Learned Public Prosecutor for respondent/ State has opposed the bail application and prays for its rejection by contending that on the basis of the allegation and the material available on record, no case for grant of anticipatory bail is made out
It is seen from the record that by an interlocutory order dated 04/05/2012 subsisting till date passed in M.Cr.C.No. 3034/2012 filed u/s 482 of Cr.P.C., this Court had protected the petitioner by restraining the respondents from arresting the petitioner. Since M.Cr.C. No. 3034/2012 is still pending and the interim protection is subsisting as pointed out by Learned Counsel for petitioner this anticipatory bail application is not maintainable and therefore is dismissed with liberty to the petitioner to approach as regards any grievance he has about his apprehension of arrest in the above said M.Cr.C. No. 3034/2012.
