Judgment
The petitioner before this Court was appointed as Vice-Chairman of the Uttarakhand Krishi Utpadan Mandi Samiti, Khatima, District Udham Singh Nagar on 18.07.2016. He has challenged the validity and propriety of the order dated 28.03.2017 passed by the Additional Chief Secretary, Agriculture, Government of Uttarakhand, by which in exercise of power under Section 17 (4) (a) of the Uttarakhand Agriculture Produce Marketing (Development & Regulation) Act, 2011, the term of each of the "Mandi Samitis" in Uttarakhand has come to an end and an administrator has been appointed in order to run the "Mandi Samitis".
In a bunch of writ petitions which were earlier filed before this Court by similarly situated persons challenging the order dated 28.03.2017, this Court vide its judgment and order dated 22.06.2017 has already allowed the writ petitions and has quashed the order dated 28.03.2017.
Learned counsel for the petitioner submits that this matter is squarely covered by the judgment and order dated 22.06.2017 passed by this Court in WPMS No. 725 of 2017, Ramvilash Singh Rawat Vs. State of Uttarakhand & others, as
well as other connected matters. Learned counsels for the respondents admit this factual position.
In view thereof, this writ petition also stands disposed in terms of order passed by this Court in WPMS No. 725 of 2017, Ramvilash Singh Rawat Vs. State of Uttarakhand and others and other connected matters decided on 22.06.2017.
