(per Shri Manoj Kumar Gupta, C.J.)

1)

The present intra-court appeal is directed against the order of learned Single Judge dated 16.09.2026, passed in Writ Petition (S/S) No. 2373 of 2026, which is as follows :

“Mr. Vipul Sharma, learned counsel for the petitioner.

2.

Mr. R.C. Joshi, learned B.H. for the State.

3.

By means of this writ petition, the petitioner has sought a direction in the nature of mandamus commanding the respondents to give full effect to Government Order dated 10.07.2026, whereby the petitioner, a Junior Engineer has been transferred and posted with additional charge of Engineer, Zila Panchayat, Dehradun. 4. Issue notice to respondent nos.3 and 4 returnable within four weeks. 5. Steps to be taken during course of the day. 6. Respondent(s) may file counter affidavit(s) within four weeks. 7. List this case on 28.10.2026. 8. In the meantime, petitioner may join at Zila Panchayat, Dehradun as Junior Engineer on which post he was working in Zila Panchayat, Uttarkashi.”

2)

The appellant had approached this Court by means of the writ petition seeking implementation of the order of the State Government dated 10.07.2026, whereby he was transferred and posted as Junior Engineer, Zila Panchayat, Dehradun and was also entrusted with the additional charge of Prabhari Abhiyanta, Zila Panchayat, Dehradun, till further orders.

3)

The appellant, admittedly, holds the post of Junior Engineer. The interim order granted to the petitioner entitles him to join as Junior Engineer in compliance of the order of the State Government. The question as to whether the Zila Panchayat was justified in denying the petitioner the additional charge of Prabhari Abhiyanta, Zila Panchayat, Dehradun, is still to be considered in the writ petition.

4)

In such view of the matter, there is no occasion for this Court to interfere with the interim order by which partial relief has been granted to the petitioner pending adjudication of the matter.

5)

The appeal is, accordingly, dismissed.

6)

All pending applications stand disposed of accordingly.
