Judgment
K .M. Joseph, C.J. (Oral) Â Â Â Â Â Â Â Â
The writ petition has been filed seeking the following relief:
“i) issue a writ, order or direction in the nature of mandamus directing the concern respondents to pay the complete stipend to petitioner from 19-
04-2014 to 29-062014 (having regard to the annexure no. 3 to the writ petition).â€
Briefly put, the case of the petitioner is as follows:Â Â Petitioner joined as a Medical Officer at Bageshwar District Hospital and, thereafter, he
was selected for P.G. course, i.e.M.D. Community Medicine. Thereafter, he joined the Department.Â
Petitioner has not been stipend for the period from 19-04-2014 to 2906-2014. In this regard, the petitioner wrote Annexure-3 to the Principal,
Government Medical College, Haldwani, District Nainital. Â
Petitioner has already represented Annexure -3 to the Principal, Government Medical College, Haldwani, District Nainital, but there is no dispute
that the second respondent is the person competent to take a decision. Â
In such circumstances, treating the writ petition as a demand, we direct that the second respondent will consider and take a decision on the claim of
the petitioner for stipend for the period from 19.04.2014 to 29.06.2014 within a period of one month from the date of production of a certified copy of
this judgment before the second respondent.Â
The writ petition stands disposed of.Â
