Judgment
Dinesh Maheshwari, J.—Having heard the learned Counsel for the petitioner and having perused the material placed on record, this Court is unable to find any reason to entertain this writ petition against the order dated 24.01.2009 (Annex.6) as passed by the Family Court, Udaipur allowing an application u/s 24 of the Hindu Marriage Act as moved by the respondent and directing the petitioner-husband to make payment of the maintenance amount of Rs. 2,000/- for the wife, Rs. 1,000/- for the son and further an amount of Rs. 1,000/- towards litigation expenses apart from travelling charges for attending the dates of hearing.
Viewed from any angle, the amount as awarded by the learned Family Court towards maintenance and litigation expenses could only be said to be rather on the lower side. There appears no reason for considering any downward revision in the said amount.
Learned Counsel for the petitioner submitted that if the notices are issued, the matter could be settled between the parties.
So far settlement/conciliation is concerned, when the petitioner has himself filed the application u/s 13 of the Hindu Marriage Act that remains pending, for any such proposition, it is always open for the petitioner to make submissions before the Family Court concerned; but for that matter, there appears no reason to issue notices and to keep this writ petition pending.
The writ petition stands rejected.
