Judgment
Tarlok Singh Chauhan, J
The instant petition has been filed for grant of the following substantive relief:
“ that the writ of mandamus may kindly be issued and the respondent/State may kindly be directed to pay the salary and allowances to petitioner for the period of training with all consequential benefits in view of judgment passed by this Hon’ble Court in CWP (T) No. 2145/2008 and LPA No. 480/2011.
2 Learned Additional Advocate General has placed on record instructions, dated 21.11.2022, relevant portion whereof reads as under:-
“It is submitted that on 12.10.2022, the file related to salary of training period of Panchayat Secretaries was received in the Department from AD with observation of Finance Department to re-assess the liabilities on account of salary of training period of Panchayat Secretaries involved in different CWP's. Accordingly, after doing the needful, file was re-submitted to Finance Department for consideration and vide communication dated 29.10.2022, the Finance Department has conveyed its concurrence and has advised to implement the same within the requirements of Model Code of Conduct. Therefore, the same shall be implemented after the Model Code of Conduct is over.”
3 Now that the Finance Department has given its concurrence, in principle, for grant of salary of training period to the Panchayat Secretaries and the respondent-Department, in turn, has undertaken to release the financial benefits after the model code of conduct is over, we deem it appropriate to dispose of the instant petition by directing the respondents to abide by the aforesaid undertaking. Ordered accordingly.
