Judgment
WE have heard the parties. It is admitted position that the amount of Rs. 1,344.90 is lying with the respondents M/s. Maslana Kalan Agricultural Services Co-operative Society Limited, since, September, 1987.
THE complainant/appellant states that the Society/respondents should return the amount lying with them with interest. Shri Durga Sharma, Secretary, appeared for the respondents states that they have no objection for returning the amount, but the complainant/appellant is not entitled for the interest, because the amount is lying deposited in the suspense account. We asked the Secretary, appearing for the respondent that he should substantiate that the interest is not payable on the amount lying with them under any rule or law. He has failed to show any law on this question. It appears reasonable that when the amount of the complainant/ appellant is lying with the respondents, why should not the same be returned to him with interest. We therefore, accordingly direct the respondent to pay the amount of Rs 1,344.90 alongwith interest @ 9% per annum w.e.f. September, 1987, since when the amount is lying with them. The payment should be made by the respondents to the complainant/ appellant within 15 days. The appeal is accordingly disposed of with no orders as to costs. Appeal disposed of.
