Narayanasamy Naidu vs The State

This Criminal Original petition has been filed by the defacto complainant to direct the learned Judicial Magistrate, Thirumangalam to dispose of

the case in C.C.No.326 of 2015, pending on his file at early.

Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal side) appearing for the respondent.

The learned counsel for the petitioner submitted that the petitioner is aged about 75 years. He further submitted that based on the complaint

given by the petitioner, the case was registered in the year 2013 under Sections 420, 468, 471 of I.P.C and the police has filed charge-sheet on

22.10.2015. He further submitted that since the petitioner is an aged persons, the learned Magistrate may be directed to dispose of the above case

at early.

The learned Government Advocate (Criminal side) submitted that one of the accused (A-4) has filed a petition to discharge him from the above

case in Crl.M.P.No.1954 of 2016, in which, the respondent police has to file counter.

Considering the aforesaid submission, the respondent Police is directed to file counter in the said discharge petition within a week from the date

of receipt of a copy of this order. Thereafter, the learned Judicial Magistrate, Thirumangalam shall dispose of the said petition within a month. After

disposing of the said petition, the learned Judicial Magistrate, Thirumangalam should expedite the trial in C.C.No.326 of 2015 and dispose of the

same at early.

With the above observation, this Criminal Original petition is disposed of.
