Heard Mr. P.K. Pal, learned counsel appearing for the petitioner as well as Mr. M. Debbarma, learned Addl. G.A. appearing for the respondents.

By means of this petition, the petitioner who is a DRW(Group-D) worker under the PWD Water Resource has urged this court to direct the respondents to pay his wages for the working period starting from 01.04.2019 onwards.

There is no dispute that by virtue of the memorandum under No.F.No.1(324)CE/WR/UC/12 dated 20.03.2013 [Annexure-1 to the writ petition] the petitioner has been upgraded to DRW(Group-D) from his earlier engagement as part-time worker with effect from 01.12.2012. According to the petitioner, he has been working without any wage from 01.04.2019. His last monthly wages was credited in his Savings Bank Account maintained by the Tripura State Co-operative Bank, Teliamura on 02.04.2019 and thereafter, despite his work as the DRW, he has not been paid any amount. The petitioner has been working as the Pump Operator for irrigation under the PWD Water Resource Division. The petitioner has made a representation on 01.02.2020 urging for release of his wages since April, 2019 but without any yield. Hence, he has been persuaded to file this petition before this court.

Mr. M. Debbarma, learned Addl. G.A. appearing for the respondents has submitted that the petitioner should be deemed to have retired from service on 30.06.2019 afternoon. Thereafter, he is not supposed to get any wage from the respondents.

Be that as it may, having regard to the limited relief prayed in this writ petition, the respondents are directed to release the wages till 30.06.2019 as the DRW and thereafter on inquiry, if it is found he had really worked after 30.04.2019 the wages for the working period shall also be paid in terms of the wages that the petitioner was entitled before his disengagement for superannuation. Such payment shall be made within a period of three months from the date of receipt of a copy of this order.

Having observed thus, this writ petition stands allowed to the extent as indicated above.

There shall be no order as to costs.
