Judgment

This is a Civil Writ Petition filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for setting aside the order dated 19.1.2024 (Annexure P-7) passed by respondent no.3.
A perusal of the letter/correspondence dated 19.01.2024 would show that reference has been issued in compliance to the order dated
10.2023 of the State Information Commission, Haryana which order has neither been produced on record nor has been challenged.
Learned counsel for the petitioner has submitted that despite efforts of the petitioner copy of the order dated 10.10.2023 has not been given to him.
Learned State counsel has submitted that it is not possible that in case the petitioner had applied for copy of the order and the same was not given, however, she submits that without getting into the veracity of the said submission the respondent authorities have no objection in providing copy of the aforesaid order, in case the petitioner is ready to apply for the same and pay the necessary fee.
Learned counsel for the petitioner has submitted that the petitioner would apply for the copy of the same within a period of one week from today.
In case of petitioner doing so, the State Information Commission, Haryana is directed to supply a copy of order dated 10. 10.2023 to the petitioner preferably within a period of 10 days from the date of moving of the application.
Keeping in view the above said facts and circumstances of the case, present petition is disposed of with the following directions:-
(i) The petitioner is permitted to apply for a copy of order dated 10.10.2023 passed by the State Information Commission, Haryana reference of which has been made in the letter/correspondence dated 19.01.2024 (Annexure P-7) along with the requisite fee.
(ii) In case of the petitioner doing so, office of State Information Commission, Haryana is directed to supply copy of the order dated 10.10.2023, within a period of 10 days from the date of the application.
It is made clear that in case after getting the copy of the said order, it would be open for the petitioner to challenge the same in accordance with law.
Petition is disposed of in the above terms.
