Judgment
Heard the learned counsel for the petitioner. Petitioner is accused of having grown cannabis plants and therefore on allegations of being in possession of Ganja weighing about 35 kgs., he has been arrested. It would seem on the face of it that the allegations of the petitioner, being in possession of Ganja plants would itself dilute the case of the prosecution. ''Ganja'' has a specific definition and if the seized material included leaves, steams and other parts of the cannabis plants, which would not conform to the definition of ''Ganja'' and therefore, it would not be in a position to indicate the quantity that was actually seized as Ganja. In that view of the matter the petitioner is held entitled to be enlarged on bail.
Accordingly, the petition is allowed. The petitioner shall be enlarged on bail subject to the following conditions:
(i) The petitioner is held entitled to be enlarged on bail on his furnishing a self bond for a sum of Rs.30,000/- (Rupees Thirty Thousand only) with a surety for the likesum to the satisfaction of the court below.
(ii) The petitioner shall not tamper with the evidence or prevail upon the prosecution witnesses in any manner.
(iii) The petitioner shall attend the Court on all dates of hearing.
(iv) The petitioner shall not leave the jurisdiction of the Court below without prior permission.
