The cause of action for this writ petition has arisen within the territorial jurisdiction of the Circuit Bench of High Court of Karnataka at Dharwad. It was filed during the Dasara vacation i.e. on 25.10.2012 at the Principal Bench of High Court of Karnataka at Bangalore. During the vacations, litigants were permitted to file the cases only at the Principal Bench of High Court of Karnataka at Bangalore. That is how this writ petition was entertained. Therefore, Registry is directed to transfer this case to the Circuit Bench of High Court of Karnataka at Dharwad forthwith. In so far as the Principal Bench of the High Court of Karnataka at Bangalore is concerned, this writ petition stands closed. After the receipt of the records, Registry of the Circuit Bench of High Court of Karnataka at Dharwad is directed to assign fresh case number to this writ petition and post the case before the appropriate Court immediately thereafter. All the contentions on merits are kept open.
