Hon’ble Pankaj Purohit, J.

This writ petition has been filed seeking a writ of certiorarified-mandamus for quashing the order dated 14.07.2025, annexure no.1 to the writ petition, whereby the learned Additional District Judge, Commercial Court, Dehradun informed respondent no.4-UPNL that services of Shree Nandan Singh, Clerk, were no longer required in the court of learned Additional District Judge, Commercial Court, Dehradun.

2.

Affidavit filed by the petitioner is taken on record.

3.

It is contended by learned counsel for the petitioner that petitioner was working with respondent no.3 as a Clerk on contractual basis since 04.03.2024 and by the said order petitioner was disengaged and a letter was communicated to respondent no.4-UPNL to do the needful.

4.

It is contended by learned counsel for the petitioner that the order is not as innocuous as it appears from its language and something is there behind back of the order; the services of the petitioner are required by respondent no.3.

5.

Learned counsel for the petitioner also submits that till date no person has been engaged by respondent no.3 on the post held by the petitioner.

6.

I have perused the order dated 14.07.2025. The parties are ad idem that till date no person has been engaged by respondent no.3 on the post of Clerk in the Commercial Court, Dehradun, which reflects that services of the petitioner are not required by respondent no.3.

7.

In such view of the matter no interference is required.

8.

Accordingly writ petition stands disposed of. However it is made clear that if respondent no.3 is inclined to engage any person through outsourcing agency on the post held by the petitioner, the petitioner shall be given due preference.
