I. A. No. 5339 of 2022

1.

This application seeks amendment of the prayer of writ petition and for impleadment of Opposite Parties.

At the oral request of Mr. Palit, Opposite Party No.5 is deleted from array of Opposite Parties.

For the reasons stated therein, the application is allowed and the Opposite Parties mentioned in the schedule to the application are added as Opposite Party Nos.5, 6 and 7.

At the request of Mr. Subir Palit, learned counsel for the Petitioner, M/s. National Aluminium Company Limited (NALCO) is arraigned as Opposite Party No.8.

The consolidated cause title of the writ petition along with the prayer portion incorporating the amendment be filed before the next date.

Learned counsel for the Petitioner has filed an additional affidavit in Court today, which is taken on record.

Issue notice.

Ms. Pami Rath, learned counsel, who usually appears for NALCO is requested to accept notice on behalf of NALCO-Opposite Party No.8 and obtain necessary instructions.

Mr. P. K. Parhi, learned Assistant Solicitor General of India accepts notice for Opposite Party No.1 and newly added Opposite Parties 5, 6 and 7 as well.

Let required number of copies of the petition be served on Mr. Debaraj Mohanty, learned counsel, who normally appears for Mahanadi Coalfields Limited (MCL) in course of the day. He is requested to accept notice for MCL.

Learned counsel for the Petitioner is directed to serve required number of copies of the petition on Ms. Rath, learned counsel, Mr. Parhi, Assistant Solicitor General of India and Mr. Mohanty, learned counsel appearing for the respective parties in course of the day to enable them to take instructions.

List on Monday i.e. on 25th April, 2022.

In the meanwhile, if a request is made by NALCO to the East Coast Railway to allocate four rakes per day to transport coal from MCL’s Bharatpur Mines to NALCO’s plant at Angul, such request should be considered by the East Coast Railway on priority basis.

14.

Issue an urgent certified copy of this order as per rules.
