Judgment

The petitioner is a B.Arch student doing his 3rd semester in the KMEA College of Architecture. In the month of January, he met with a motor accident and suffered brain injury. Medical records in the said regard have been produced along with the writ petition as Exts.P1 to P5. The written examinations for the 3rd semester have already commenced and are to end today (05-04-2023). The tentative date for the conduct of re-jury examinations is 10-04-2023. If the petitioner is permitted to appear for the re-jury examinations, he can make up his deficit attendance by appearing for further classes along with the next batch and have the course completed without losing one year, submits the learned counsel for the petitioner. Accordingly, the petitioner prays for permission to appear for the re-jury examinations scheduled to be held tentatively on or after 10-04-2023.
Heard the learned counsel on both sides.
Exts.P1 to P5 indicates that the petitioner suffered brain injury consequent to an accident. The medical records justify his absence from the College. He is reportedly short of attendance by 35 days. Though the written examinations are over, the re-jury examinations are proposed to be held on 10-04-2023.
Taking note of the entire circumstances as above, I am of the opinion that the petitioner could be permitted to appear for the re-jury examinations without regard to shortage of attendance, if any. As regards, the petitioner’s appearance for the next turn of the written examinations, the College shall consider the same and provide necessary assistance to enable him to acquire the attendance as prescribed.
The writ petition is disposed of as above.
