Judgment
The petitioner herein stands arrayed as the second accused in Crime No.850/2018 of Museum Police Station, Thiruvananthapuram, for offences punishable under section 22 (C ) and section 29 of NDPS Act.
The prosecution case is that the petitioner was arrested red-handed on 31.07.2018 with 506 gms of Methaqualone.
The bail application filed by the petitioner was rejected earlier considering the nature of allegations and also the quantity of the drugs involved. It is now reported that the co-accused was granted bail by the order of this court in Ba.No.2194/2019. Having considered this, I feel that the petitioner herein stands on the same footing as that of the co-accused is also entitled for bail. Accordingly, I am inclined to grant bail to the petitioner on the following conditions:
(i) Petitioner shall execute a bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with two sureties for the like sum each to the satisfaction of the jurisdictional Court.
(ii) He shall appear before the investigating officer as and when called for and co-operate with the investigation.
(iii) He shall not threaten, coerce or intimidate the defacto complainant and the witnesses nor shall he interfere in the process of investigation.
(iv) He shall not get involved in any other crime and involvement of it, will be a ground for cancellation of bail in this case.
Bail application is allowed as above.
