Judgment
Adarsh Kumar Goel, J.—The petitioner is aggrieved by action of respondent No. 5 District Food and Supplies Controller, Barnala in seeking to terminate the contract given to the petitioner on the ground of alleged breach of condition of supplying the vehicles for transportation as per show cause notice dated 13.10.2008 (Annexure P-7). Contention raised on behalf of the petitioner is that the petitioner had been supplying the vehicles but on account of malafide reasons, the respondent No. 5 proposes to cancel the contract and allot the same to someone else.
We are of the view that the writ petition is not a forum where disputed question as to whether the petitioner has committed breach of contract or not can be settled.
Dismissed.
However, we make it clear that final decision may be taken by respondent No. 5 on the representation/reply of the petitioner to the show cause notice expeditiously and as far as possible within one week from the date of receipt of a copy of this order.
