Judgment
The case of the petitioner in Writ Petition No.16 of 2024 is against the call for a strike issued by respondent Nos. 3 and 4, namely, the All India Truck Operator Welfare Association, Mahanadda Jabalpur and Jabalpur Transport Association w.e.f. 01.01.2024 with some other directions. It is pleaded that the strike called for by the aforesaid associations is contrary to law and cannot be permitted. That the transporters dealing with the essential commodities and other important commodities cannot be allowed to stop the transport operations.
The case of the petitioner in Writ Petition No.23 of 2024 is that respondent Nos. 6 and 7-Transport Unions have given a call that they shall not move their tankers which supply petroleum products like petrol, diesel etc. Since the tankers transport essential commodities, the day to day life of everyone is affected.
Shri Prashant Singh, Advocate General with Shri Amit Seth, Deputy Advocate General and Shri Suyash Thakur, Government Advocate takes notice for respondent Nos. 1 and 2/State in WP No.16 of 2024 and for respondent Nos. 1 to 4, 9, 10 and 11/State in WP No.23 of 2024.
Shri Sandeep Shukla, Advocate takes notice for respondent No.5/Union of India in WP No.23 of 2024.
Issue notice to respondent Nos. 3 and 4 in WP No.16 of 2024 and respondent Nos. 6, 7 and 8 in WP No.23 of 2024.
The learned Advocate General submits that in terms of the provision of Section 5 of the Essential Commodities Act, 1955 and the notification issued by the Central Government dated 30.11.1974 and subsequent notifications, the State Government would pass necessary orders as soon as possible in terms of the power vested under it. He further submits that keeping in mind the fact that the general public are being affected by this act being committed by the concerned respondents and since the day-to-day supply of even the essential commodities is being hit, appropriate orders would be passed in the said regard.
