Judgment
Both the above bail applications shall stand decided by this common order as they arise out of the same FIR.
The present applications for anticipatory bail have been filed by the petitioners apprehending their arrest in connection with F.I.R. No.74/2016, Police
Station Kuchaman City, District Nagaur for the offences under Sections 403, 406, 417, 420, 465, 467, 468, 471 & 120-B IPC.
Heard learned counsel for the petitioners and learned Public Prosecutor. Perused the material available on record.
Learned counsel for the petitioners submits that the loan amount from the different banks to the tune of Rs. 5,21,00,000/-(Rupees: Five Crores Twenty
One Lakhs Only) with interest has been repaid to the respective banks. No due certificates from the respective banks have already been obtained.
The present FIR is nothing but an outcome of the family discord between the petitioners and the complainant. He further submits that for the similar
allegations, on the previous occasion also an FIR No. 88/2012 was filed wherein anticipatory bail was granted vide order dated 18.02.2014.
The learned Public Prosecutor opposes the bail applications. Having regard to the facts and circumstances of the case and
upon a consideration of the arguments advanced at the bar, this Court is of the opinion that it is a fit case for grant of anticipatory bail to the petitioners
under Section 438 Cr.P.C.
Accordingly, the present anticipatory bail applications are allowed and it is directed that in the event of arrest of petitioners (1)Nagendra Singh
Rathore S/o Shri Ranjeet Singh Rathore, (2)Ranjeet Singh Rathore S/o Late Shri Jugal Singh Rathore, (3)Gaurav Singh Rathore S/o Shri Ranjeet Singh
Rathore, & (4)Smt. Seeba Rathore W/o Shri Ranjeet Singh Rathore in connection with F.I.R. No.74/2016, Police Station Kuchaman City, District
Nagaur, the petitioners shall be released on bail; provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Rupees: Fifty Thousand
Only)each along with two sureties of Rs.25,000/- (Rupees: Twenty Five Thosuand Only) each to the satisfaction of the concerned Investigating
Officer/S.H.O. on the following conditions :-
(i) that the petitioners shall make themselves available for interrogation by a police officer as and when required;
(ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as
to dissuade him from disclosing such facts to the court or any police officer; and
(iii) that the petitioners shall not leave India without previous permission of the court.
