This Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure seeking quashment of the charge sheet in CC.No.385 of 2023 on the file of the learned Judicial Magistrate No.IV, Tirunelveli. It is submitted by the learned counsel for the petitioners that subsequent to the filing of the charge sheet, the petitioners and the defacto complainant have settled the disputes outside the Court. It is also submitted that both parties have also filed memo of compromise.
2.Considering the submission made above, the Officer in-charge of the High Court Legal Services Committee is directed to verify the identity of the defacto complainant and the accused persons with the aid of Aadhar card or any other recognised identity cards and ensure that the latest photograph of the defacto complainant and the accused are affixed on the memo of compromise. Further, the respondent police are also directed to be present and identify the defacto complainant and accused. After establishing identity, the Officer in-charge is directed to inquire, informally, as to whether there is any force or coercion on either of the parties compelling them to compromise the case. The Officer in-charge is directed to file the report by 29.09.2023.
3.The parties are directed to appear before the Officer in-charge, High Court Legal Services Committee on 22.09.2023 and for filing the report, list on 29.09.2023.
