The present misc. Petition has been filed for the following relief:-
It is, therefore, most humbly and respectfully prayed that the criminal misc. petition filed by the petitioners may kindly be allowed and give the directions to expedite the trial on day to day hearing for conclusion of the trial within the period of six months in the Session Case No. 10/2013 (CIC No. 68/14) (State vs. Raju @ Rajukumar & Ors.) at Additional Sessions Judge, Didwana, District Nagaur, Judgeship-Merta;
Learned counsel for the petitioners submits that the petitioners are facing the trial since last nine years in pursuance of the F.I.R. No. 0118/2012 lodged at Police Station Maulasar, District Nagaur. He further submits that the petitioners are facing incarceration for almost nine years and during this period out of 38 witnesses only 9 witnesses have been examined so far.
I have considered the prayer and the submissions made by the counsel for the petitioners.
It is true that the petitioners are facing incarceration for the last nine years and only 9 witnesses have been examined out of 38 witnesses, the learned trial court is directed to explore the possibility by summoning the witnesses for examination at its earliest convenience.
With these observation and direction, the present misc. petition stands disposed of.
