This bail application has been dismissed as withdrawn on 01.02.2024 and during the pendency of this bail application, the petitioner had moved the Court of Sessions for bail and his prayer for bail had been allowed.
Perused the report dated 30.03.2024 of the learned Addl. District and Sessions Judge, Kujang alongwith order dated 29.01.2024 and 31.01.2024 and 29.03.2024 and copy of the letter dated 28.03.2024 of the learned J.M.F.C. (P), Kujang addressed to the learned Addl. District and Sessions Judge, Kujang, Jagatsinghpur. The learned Addl. District and Sessions Judge, Kujang has reported that the order passed in BLAPL No.448 of 2024 was recalled on 29.03.2024 and the petitioner has surrendered in the Court on the same day and has been taken to custody and in the meanwhile the case has been committed to the said Court and has been registered as C.T. Case No.42 of 2024.
It is open to the petitioner to move the learned Court below for bail afresh if so advised after giving accurate statement regarding filing and disposal of earlier bail applications. In such event the prayer for bail shall be considered on its own merit.
Urgent certified copy of this order be granted on proper application.
