The petitioner, stated to be the owner of 0.2024 hectares of land comprised in Old Survey Nos. 32/1A & 32/2A, Re-Survey Block No.38, Re-Survey Nos. 20/1 and 20/97 of Palakkad Taluk in Marutharoad Village in Palakkad District, has preferred Ext.P5 Form-A application under Section 6A of the Kerala Land Tax Act, 1961 (for short, ‘the Act’) for fixation of the rate of basic tax consequent to the change in user of the property.
The learned counsel for the petitioner submits that no orders have been passed on the said application so far. The learned Government Pleader, on instructions, submits that the same is pending.
Under such circumstances, there will be a direction to the 2nd respondent-Additional Tahsildar (LR) to consider Ext.P5 application submitted by the petitioner and after ascertaining the genuineness of Ext.P2 KLU Order and also, after ascertaining the identity and extent of the property, pass appropriate orders on the same, strictly in terms of the Act, within three months from the date of receipt of a copy of this judgment.
The Writ Petition is disposed of as above.
