Learned counsel appearing on behalf of the petitioner submits that the petitioner is the brother in law of the victim lady. First, the victim lady had
lodged an FIR under Section 498A against the husband and other relatives. Thereafter, only to harass the in laws, the present case was started by
way of an application under Section 156(3) of the Code after about 30 days from the date of the alleged incident. Learned counsel appearing on behalf
of the State opposes the prayer for anticipatory bail. However, in his usual fairness, he admits that the victim had refused medical examination.
Considering the nature of allegation and the materials available, we do not think that custodial interrogation of the petitioner is required in this case.
Accordingly, we allow the application for anticipatory bail.
In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs. 5,000/- (Rupees Five Thousand only) with one surety, to the
satisfaction of the arresting officer and subject to the condition that the petitioner shall meet the investigating officer once a week.
The application for anticipatory bail being C.R.M. 5348 of 2020 and C.R.A.N. 3663 of 2020 are disposed of.
