This writ petition is filed seeking the following reliefs :-

“i) to issue a writ of mandamus or any other appropriate writ order or direction directing the 1st Respondent to dispose of his representation as

expeditiously as possible.

ii) to declare that the Petitioner is entitled for retiral benefits and for release of gratuity which amount is already with the Respondents.â€​

Heard the learned counsel for the petitioner and the learned standing counsel appearing for the KSEB.

It is submitted by the learned counsel for the petitioner that the petitioner had been working as Line Assistant in the respondent-Board from 1967

onwards. It is stated that the petitioner had been terminated from service with effect from 16.03.1994 on the ground of unauthorized absence. It is

submitted that the petitioner is aged 78 years. He had preferred Ext.P2 representation before the 4th respondent seeking release of terminal benefits

due to him. It is submitted that the said representation has been enquired into by the 4th respondent, but no steps have been taken thereafter.

The learned standing counsel appearing for the respondents submits that the representation preferred by the petitioner is highly belated. But after

verification of the available records, it will be considered whether any amounts are due to the petitioner.

Having considered the contentions advanced on either side, I am of the opinion that since the petitioner has approached the respondents with a

representation, even though belatedly, the same is liable to be considered and steps are to be taken to release amounts, if any, due to the petitioner.

In the above view of the matter, this writ petition is disposed of directing a consideration of Ext.P2 representation preferred by the petitioner by the

appropriate authority in the 1st respondent. Steps shall be taken to ascertain and release any amounts standing in the petitioner's credit within a period

of three months from the date of receipt of a copy of this judgment. In case no amounts are found due also, the petitioner shall be informed

accordingly.

This writ petition is ordered accordingly.
