Judgment
A.S. Pachhapure, J.—The Company representative of TATA Teleservices Limited submitted a complaint dated 16.12.2010 alleging that it is the licensed Telecommunication services provider engaged in the business of providing telephone services to customers and in order to provide the said cervices to customers, they have appointed distributors, who in turn have appointed retailers. They made an enquiry with regard to one customer viz., Rama Murthy V.V., wherein the Petitioner is the dealer and he granted 7 telephone connections to the said Rama Murthy V.V., without securing the complete address and other necessary particulars. It is in these circumstances, a complaint came to be filed against the Petitioner for the offence punishable under Sections 419, 420, 468 and 471 IPC.
The Petitioner submits that he is innocent and has not committed any offence much less the one alleged. He also submits that he is ready and willing to abide by any condition/s that may be imposed for his release on bail. On these grounds, he has sought for anticipatory bail.
I have heard the learned Counsel for the Petitioner and the learned High Court Government Pleader.
Taking into consideration the nature of the offences it appears that the Petitioner has reasonable apprehension of his arrest in the hands of the Police and therefore he is entitled to anticipatory bail sought for.
In that view of the matter, the petition is allowed. The Petitioner is ordered to be released on bail in the event of his arrest in Cr. No. 455/2010 of Yeshavanthapura Police Station, Bangalore City, registered for the offences punishable under Sections 419, 420, 468 and 471 IPC on executing a personal bond for a sum of `25,000-00 with two solvent sureties for the like sum to the satisfaction of the arresting authority with further following conditions:
1) The Petitioner shall appear before the Police concerned, within 15 days from today.
2) He shall be made available for interrogation by a police officer as and when he is required.
3) He shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
4) He shall attend the Court as and when directed.
5) He shall appear before the concerned Police Station every Sunday in between 9.00 and 10.00 a.m. till the charge sheet is filed.
