This petition has been filed seeking to quash the impugned notice issued by the respondent in Na.Ka.No.6140/2026/F1, dated 25.08.2026.

Mr.M.Mahaboob Athiff, learned Special Government Pleader takes notice for the respondent.

By consent of both parties, the writ petition is taken up for final disposal at the stage of admission itself.

The learned counsel appearing for the petitioner would submit that the petitioner is in possession and enjoyment of Old T.S.No.8548/6 Part, which is classified as “Natham” to an extent of 0.0039.4 square metres. The petitioner has an electricity connection and has been regularly paying the property tax. Subsequently, the respondent arrived at a conclusion that the petitioner had encroached upon the “Pathai Poramboke”. Challenging the same, the present petition has been filed.

The grievance of the petitioner is that, without issuing any show cause notice, the respondent has straightaway passed the impugned order.

The learned Special Government Pleader appearing for the respondents would submit that the property will be surveyed in the presence of the petitioner and if any encroachment is found, the same will be removed in the manner known to law.

Considering the above submissions, the learned counsel appearing for the petitioner would submit that the petitioner may be permitted to treat the impugned order as a show cause notice and submit her reply before the respondent.

Accordingly, the petitioner is permitted to treat the impugned order dated 25.08.2026 as a show cause notice and submit her reply before the respondents within a period of two weeks from the date of receipt of a copy of this order. Thereafter, the respondents shall survey the property in the presence of the petitioner and if any encroachment is found, the same shall be removed in accordance with law, after providing due opportunity to the petitioner. The entire exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order. Till such time, no coercive steps shall be taken against the petitioner.

With the above directions, this writ petition is disposed of. No costs. Consequently, the connected miscellaneous petitions are closed.
