Rule returnable forthwith. Mr. Patel, learned APP waives service of notice of rule on behalf of the respondent – State.

The petitioner – original convict has applied for parole leave for the period of 30 days on the ground of managing financial funds for legal fees to file appeal against the order of conviction.

Mr. Patel, learned APP for the respondent – State has placed on record the jail remarks and has submitted that the application seeking parole leave has already been moved before the learned District Magistrate on 17th August, 2023 which is pending consideration.

Considering the submissions made by Mr. Patel, learned APP for the respondent – State and having perused the jail remarks, the present petition is disposed of with a direction to the Competent Authority to take appropriate decision in accordance with law on application dated 17th August, 2023 preferably within the period of 07 days from the date of receipt of this order.

With these observations, present petition stands disposed of. Direct service permitted.
