The previous Investigating Officer is present in Court. He has submitted that after investigation was launched, statements of the witnesses u/s 161 of the Criminal Procedure Code were recorded. He has submitted that statements u/s 164 of the Criminal Procedure Code were also recorded. One of the named accused persons was also arrested. Despite all efforts made, the other named accused persons could not be apprehended. He has stated that on 21st October, 2011, investigation into the matter has been transferred to C.B.C.I.D. by the State Government. In the circumstances, personal appearance of the Investigating Officer is dispensed with.

In view of what has been stated above, C.B.C.I.D. is requested to conclude the investigation as quickly as possible. Since charge sheet against the arrested person has already been filed, we request the C.B.C.I.D. to file charge sheet against the other accused persons no sooner they are apprehended.

This disposes of the writ petition.
