The petitioner/A2, who was arrested and remanded to judicial custody on 11.10.2026 for the alleged offences punishable under Section 303(2) of BNS and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.185 of 2026, on the file of the respondent police, seeks regular bail.

2.

The case of the prosecution is that the petitioner, along with another accused, was found transporting four units of lake soil in a Tipper Lorry without any valid permit or license. Consequently, the present case was registered against the petitioner and another accused.

3.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. He submits that the vehicle has already been secured by the authorities and there is no previous case against the petitioner. He further submits that the petitioner has been incarcerated in judicial custody since 11.10.2026. Hence, the petitioner may be granted bail.

4.

On the other hand, the learned Additional Public Prosecutor appearing for the respondent strongly opposes the grant of bail to the petitioner. She also submits that there is no previous case against the petitioner.

5.

Hearing both sides and perusing the materials on record, this Court takes note of the fact that the vehicle used for the commission of the alleged offence has already been secured and the quantity involved is four units of lake sand. Considering the nature of the present offence, the quantum of the seized material, the period of custody undergone by the petitioner, the stage of the investigation and that there is no previous case against the petitioner, this Court is inclined to grant bail to the petitioner, but with stringent conditions to ensure his appearance and good conduct.

6.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Ulundurpet, and on further conditions that:
