Heard on CA No. 274/2022 which is filed under Rule 11 of NCLT Rules, 2016 for brining on record the settlement arrived at between the parties.
A copy of the compromise deed dated 16.05.2022 is annexed as Annexure A-1 and copy of affidavit of petitioner Murti Devi is also annexed as Annexure A-2.
It is stated by learned counsel for applicant that on the basis of the said compromise, he may be permitted to withdraw the main petition on instructions with liberty to revive the same if there is any default in the terms and conditions of the compromise agreement. Keeping in view the statement made by applicant, CA No. 274/2022 is allowed and applicant is permitted to withdraw the CP No. 220/Chd/Hry/2017. CA No. 274/2022 is disposed of accordingly.

In view of the order passed in CA No. 274/2022 above, CP No. 220/Chd/Hry/2017 is dismissed as withdrawn with liberty to revive the same if there is any default in the terms and conditions of the compromise agreement, in accordance with law.
