Ms. A. Pal, learned counsel for the Petitioner submits upon instruction that the Collector, Puri is the competent authority to allot the Kiosk/Stall to the vendors within the master plan area.

Heard Ms. A. Pal, learned counsel for the Petitioner, Mr. T.K. Dash, learned Additional Government Advocate for State- Opposite Parties and Mr. S.B. Jena, learned counsel for Opposite Party No.2-Konark NAC.

The Petitioner has prayed for allotment of the Kiosk/Stall under the master plan area after demolition of his wooden cabin of OMFED Stall by the authorities.

It is not disputed by the Opposite Parties that the Petitioner was running his business of OMFED Stall in the wooden cabin within the NAC area of Konark near Konark Temple. Now as per the master plan, all the existing cabins/stalls were demolished and it is to be allotted in a planned way.

As stated above, the Collector being the competent authority for allotment of Kiosk/Stall, he is directed to consider the prayer of the Petitioner for allotment of a Kiosk/Stall in favour of the Petitioner at a suitable place within the master plan area keeping in view the fact that the Petitioner is a licensee of OMFED Stall and he had the earlier shop near the temple area. The Collector, Puri (Opposite Party No.4) is further directed to consider the prayer of the Petitioner with a sympathetic view taking note of the fact that he was earlier licensed to have the stall near the temple area. Such decision shall be taken by the Collector within a period of three weeks from the date of receipt of a certified copy of this order.

With the aforesaid observation and direction, the writ petition is disposed of.

An urgent certified copy of this order be granted on proper application.
