K.A. Abdul Gafoor, J.—There arose a vacancy of Management Instructor in the Health and Family Welfare Training Centre. One among the required qualifications in "Master''s degree in Public Administration or Business Administration from a recognised University. The 2nd respondent who was holding the post of Junior Superintendent submitted an application. Petitioner was also an applicant. The 2nd respondent was appointed as per Ext. P2. That is impugned by the petitioner on the ground that the 2nd respondent does not have the required qualifications. He mainly relies on two communications from Calicut University and University of Kerala to the effect that M.A. Public Administration through Correspondence Course of the Sree Venkateswara University, Thirupathy is not recognised by the Universities in Kerala. Therefore, the 2nd respondent is not qualified. The required qualification is not degree recognised by any of the Universities in Kerala but a degree form a recognised University. The petitioner does not have a case that Sree Venkateswara University Thirupathy is not a recognized University. Therefore, that contention cannot be accepted. So, the petitioner could not substantiate his contention that the 2nd respondent was not qualified.

O.P. therefore fails. Dismissed. No costs.
