Judgment

The order of surcharge dated 17.05.2021, which is the subject matter of these writ petitions, have been withdrawn as per order dated 27.10.2021 of the Joint Registrar, affording an opportunity of personal hearing to the parties. In the light thereof, the writ petitions are closed without prejudice to the rights of either parties.
The proceedings for hearing under Section 68(2) stood notified to 17.11.2021 for hearing. As per order dated 17.11.2021 in W.P.(C) No.25298/2021, this Court had directed the date for hearing to be adjourned to 26.11.2021. It is ordered that the hearing under Section 68(2) before the Joint Registrar will stand re-scheduled to 11.00 a.m. on 07.12.2021 at the office of the Joint Registrar.
The learned counsel for the petitioners seek that a direction may be given to the Joint Registrar to have the hearing conducted taking note of the directions of this Court in W.P.(C) No.21159/2019 and connected cases. There is no reason to assume that the directions of this Court will not be taken note of and considered by the authority. Needless to say that, it will be open for the parties to place all relevant materials before the Joint Registrar for his consideration during the course of hearing.
