The applicant Muntjir is in judicial custody for the offence under Section 3, Section 5 read with Section 11 of the Uttarakhand Protection of Cow Progeny Act, 2007 and Section 11 (1)(l) of the Prevention of Cruelty to Animals Act, 1960 in Case Crime No. 252 of 2025, registered at Police Station Bhagwanpur, District Hariwar.

According to the First Information Report, a secret information was received by the police party on 30.07.2025 that buffalo is being slaughtered in the shop of Muntjir (applicant). The police party raided the shop. Police party noticed that two persons were present on the spot. The police party recovered 250 kg. beef and carabeef and other articles from the spot. Applicant was arrested. One person (co-accused Mohseen) managed to escape from the spot.

Heard Mr. Gaurav Singh, learned counsel for the applicant and Mr. Tumul Nainwal, learned Assistant Government Advocate for the respondent.

Mr. Gaurav Singh, Advocate, has contended that the applicant has been falsely implicated in the present matter. The alleged recovery is totally false. He is not a convicted person. He is a permanent resident of District Haridwar, therefore, there is no possibility of his absconding.

Mr. Tumul Nainwal, Assistant Government Advocate, has opposed the Bail Application orally.

Having considered the submissions of learned counsel for both the parties and in the facts and circumstances of the case, without expressing any opinion as to the merits of the case, this Court is of the view that the applicant deserves bail at this stage.

The Bail Application is allowed.

Let the applicant – Muntjir be released on bail on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
