Judgment

This is a peculiar case requiring interference by the Court. We are not on the point of the issues involved but rather on the assistance the appellant requires in the peculiar circumstances. The appellant is suffering from cancer and is undergoing treatment in R.C.C., Thiruvananthapuram. She is also a native of Thiruvananthapuram and is unable to continue her studies at Government Law College, Kozhikode. There is a seat available in Government Law College, Thiruvananthapuram. The problem is that the exam is nearing for the first semester and the last date for remittance of fees was fixed as 9/8/2023. But yet another problem is that the University does not allow inter-University transfer.
The learned Standing Counsel for the Kerala University submits that the academic counsel had not allowed inter-University transfer. It is to be noted that the Kerala University First Ordinances, 1978 Chapter III provides such transfers.
The learned Government Pleader submitted that there is a vacancy at Government Law College, Thiruvananthapuram in Unitary LL.B 2022-23.
Since the exam has not been conducted so far, in this matter there will not be any difficulty for the Kerala University to admit the appellant to the vacancy now available. The University, considering the peculiar circumstances, shall allow the appellant to be registered for the Unitary LL.B (Regular) 2022-23. The University is also directed to allow the appellant to pay fees before 31/8/2023. The Calicut University shall also relieve the appellant forthwith and forward all the necessary documents to readmit her at Government Law College, Thiruvananthapuram, affiliated to the University of Kerala. We make it clear that this direction is issued taking note of the peculiar circumstances of this case and without adverting to the merits of the controversies of the disputes involved.
The writ appeal is disposed of as above.
