The accused applicant is charged in case Crime No. 481 of 2007 under sections 420, 467, 468 and 471 I.P.C. pending in the Court of Special Chief Judicial Magistrate Kanpur Nagar for fabrication of documents Registration Record.
Heard Sri Satish Trivedi, Senior Advocate assisted by Sri Jitendra Singh Lodhi, advocate for the applicant and Sri Arvind Tripathi, Addl. Government Advocate for the State.
He was record keeper in Sub Registrar''s Office Kanpur Nagar. The original entry was subsequently changed in the register and the name of the vendee was changed and a certified copy with the changed name was issued and there was an earlier copy with the name of original vendee already been issued earlier. There was as such a clear interpolation in the register.
The Counsel for the accused has pointed out that the accused is 62 year of age and has now retired but these are not sufficient ameliorative feature. The records in the Registration office are sacrosanct and there is a presumption of their veracity. Any interpolation in the name is something which undermines the confidence of the public and is tantamount to grofes breach of trust.
The accused does not deserve bail.
We have been informed that no departmental enquiry has been initiated which is a very surprising feature. Such departmental inquiries are also helpful in criminal cases against the errant officer. We hope a departmental enquiry will be in the offing.
