Judgment
The instant application has been filed by Multiple Special Steel Private Limited (for brevity 'The Applicant') under the provisions of Section 9 of
Insolvency and Bankruptcy Code, 2016 (""IBC, 2016"") read with Rule 6 of the Insolvency and Bankruptcy (Application to Adjudicating Authority)
Rules, 2016 for initiation of Corporate Insolvency Resolution Process (CIRP) of M/s Sungil India Private Limited (for brevity 'Corporate Debtor).
Since the Corporate Insolvency Resolution Process (CIRP) has been already initiated against the present Corporate Debtor in IB-492(ND)/2018,
Vaiva Metals and Alloys Private Limited Vs. Sungil India Private Limited vide order passed by this bench, dated 01.06.2018, this Application has
become redundant.
The Interim Resolution Professional(IRP) appointed for the present Corporate Debtor M/s Sungil India Private Limited for this Corporate Debtor is
Mr. Rajesh Parikh, having mail id.- [email protected] is duly registered with Insolvency and Bankruptcy Board of India and having registration
No. IBBI/ IPA-001 / IP-P00272 / 2017-18/10516.
The Applicant is hence directed to file its claim before the IRP as mentioned above in appropriate form as per the provisions of IBC, 2016.
The IRP is further directed to accept the claim of Corporate Debtor and adjudicate the same as per law.
The Application is disposed of in terms of the said order as above.
A copy of the order shall be communicated to the Applicant as well as to the Corporate Debtor above named by the Registry. The IRP above
named be also furnished with copy of this order forthwith by the Registry.
