Judgment
Arindam Lodh, J
Heard Mr. S. Deb, learned senior counsel assisted by Mr. SB Debnath, learned counsel appearing for the applicants. Also heard Mr. PS Roy, learned counsel appearing for the respondents.
This is an application for condonation of delay of 90 days in preferring the appeal under Rule 9 of Order XLI of the CPC.
Mr. S. Deb, learned senior counsel appearing for the applicants has submitted that the delay caused in preferring the appeal was unintentional and the reasons for the same have been sufficiently explained in the instant application.
Mr. PS Roy, learned counsel appearing for the respondents did not raise any objection to the said prayer for condonation of delay.
Considering the above submissions of the learned counsel appearing for the parties and after going through the reasons for causing delay, I deem it fit to allow this application.
Accordingly, the delay of 90 days in preferring the appeal is hereby condoned and the application is allowed and disposed of.
