Heard Mr. D.N. Sharma, learned counsel for the applicant, Mr. Hari Om Bakhuni, learned A.G.A. for the State and perused the record. The applicant is in jail being implicated in F.I.R. No. 26 of 2014, which has been registered under Sections 365/302/201 of I.P.C., P.S. Gadarpur, District Udham Singh Nagar.

There are three accused in the present case. Out of three accused two co-accused have already been granted bail by this Court vide order dated 15.09.2014 and 12.01.2015. The role of present applicant is on similar footing.

Considering the facts and circumstances of the case as well as the material available on record, the applicant has been able to make out a case for bail. The bail application is accordingly allowed.

Let the applicant (Mukhtiyar Singh) be enlarged on bail in the aforesaid crime on his executing a personal bond and two reliable sureties of the equal amount to the satisfaction of the Magistrate concerned. It is made clear that any observations made by this Court are only for the purposes of grant of bail. It shall not be taken into consideration at all in any other proceedings.
